What Is a Foreign Divorce Opinion Letter?
A Foreign Divorce Opinion Letter is a lawyer’s written opinion addressing whether a divorce obtained outside Canada is likely to be recognized in Ontario.
It is often used where an individual needs to demonstrate their marital status for a new marriage, legal proceeding or other official purpose.
When Is It Needed?
Before getting remarried in Ontario after divorcing in another country
When a religious or civil marriage officiant requests proof that the foreign divorce may be recognized
For a court filing or family law matter in Ontario
When an institution or government official requires confirmation of marital status
When there is uncertainty about whether the foreign divorce will be recognized in Canada

Opinion Letter
We discuss your history, the foreign divorce and your intended use for the opinion letter.
You provide the foreign divorce judgment, order, decree or certificate, along with any relevant background documents.
We review the applicable legal principles and assess whether the foreign divorce is likely to be recognized in Ontario.
If deemed appropriate, we prepare and provide your written legal opinion letter.
Does a foreign divorce automatically count in Ontario?
Not always. Whether a foreign divorce will be recognized depends on the circumstances in which it was obtained and whether the applicable Canadian legal requirements are met. Recognition often depends on the connection the former spouses had to the country that granted the divorce.
Do I need the complete divorce documents?
Yes. We will generally need a clear original of the final divorce judgment, decree or certificate, along with background information about where the former spouses lived before and during the divorce proceedings. Additional supporting documents may also be required depending on the purpose of the opinion letter.
Can you guarantee that my foreign divorce will be recognized?
No. A Foreign Divorce Opinion Letter provides a reasoned legal opinion based on the available facts, documents and applicable law. However, no lawyer can guarantee the decision of a court, marriage officiant, government office or other third party.
How long does the process take?
The timeline depends on how quickly the required documents are provided, whether translations are needed and whether the matter is legally straightforward. Once we review your file, we can provide an estimated completion timeline.
